Mr. Hogan is currently serving
a 77-year sentence for an Aggravated Robbery and 2nd Degree kidnapping offense that he did not commit. An offense that he is Actually Innocent
of.
The case against Mr. Hogan is a case of true misidentification. His entire conviction rests solely upon a single person's eye-witness testimony, as there is no actual physical
or forensic evidence
that links Mr. Hogan to this offense.
However, some context is necessary in order to understand how Mr. Hogan was put in the
position to be named as a suspect in the first place.
On March 7, 2000, Mr. Hogan was arrested for federal bank robbery charges.
It was a reprehensible offense that unfortunately and regrettably he did commit.
Mr. Hogan did plead guilty
to this offense and was subsequently sentenced to 190 months
in federal prison where he served 14 years.
The Investigator (Kirsten Ann Nelson) who arrested
Mr. Hogan for the bank
robbery also arbitrarily pinned this additional robbery on him-based solely
on a Channel 2 news report describing an aggravated robbery/kidnap in which the suspect was a tall thin white male age 17-20-in an effort
to pressure him to
testify against his co-defendant. Investigator Nelson alleged
that this description matched Mr. Hogan's at the time of his arrest. (Note:
Investigator Nelson was forced to resign for tampering with evidence in an unrelated case.)
Because Mr. Hogan was already
in custody for bank robbery,
police focused on him without
any further investigation. And, as you will discover
throughout this site, the state failed to admit one shred of physical evidence
and furthermore, failed to collect and preserve
any evidence that possessed exculpatory value which was readily apparent
and available at the time of police action and would have, without a doubt, exonerated Mr. Hogan. Consequently, Mr. Hogan was found guilty and sentenced
to 77 years to be run consecutive to his federal
sentence bringing the total to 93 years.
